Terms of Service

These Terms of Service (“Terms”) govern your use of the Pylon platform and related services (the “Service”) provided by Advosec LLC, doing business as The Pylon Group (“we,” “us,” or “our”), accessible at thepylongroup.com.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Pylon provides the following services to small and mid-size businesses:

• Pylon Reviews — Connects to your Google Business Profile, ingests customer reviews, and generates AI-drafted response suggestions that match your voice and tone. You review, edit, and approve all responses before they are posted.
• Pylon After Hours — Provisions a dedicated business phone number and automatically sends SMS messages to callers who reach your business outside of your configured business hours. You can view and reply to resulting conversations from your dashboard.

We may add additional modules and features to the Service over time. We will notify you of material changes to the Service.

2. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@thepylongroup.com if you suspect unauthorized access to your account.

You must be at least 18 years old and have the legal authority to bind your business to these Terms.

3. Billing and Payment

Free Trial

New accounts receive a 14-day free trial with full access to all features. No credit card is required to start your trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

Subscription

The Service is offered at $49 per month, which includes access to all active modules (Pylon Reviews and Pylon After Hours). Billing is handled by Stripe and occurs monthly on the anniversary of your subscription start date.

Cancellation

You may cancel your subscription at any time through your account settings or the Stripe customer portal. Upon cancellation, you will retain access to the Service through the end of your current billing period. We do not offer prorated refunds for partial months.

Price Changes

We reserve the right to change our pricing. We will provide at least 30 days' notice of any price increase. Your continued use of the Service after a price change takes effect constitutes your acceptance of the new price.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Send unsolicited or unauthorized messages, spam, or promotional content via the SMS features
• Post fraudulent, misleading, defamatory, or illegal review responses
• Impersonate another person or business
• Harass, threaten, or abuse any individual through the Service
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Use the Service to collect or harvest personal information without consent
• Interfere with or disrupt the Service or its infrastructure
• Use automated means to access the Service beyond the features we provide

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use terms.

5. AI-Generated Content

The Service uses artificial intelligence (Anthropic's Claude) to generate draft review responses and other content suggestions. You acknowledge and agree that:

• AI-generated responses are drafts and suggestions only
• You are solely responsible for reviewing, editing, and approving all content before it is posted or sent
• We do not guarantee the accuracy, appropriateness, or quality of AI-generated content
• You are responsible for ensuring that any content you approve and post complies with applicable laws and platform policies
• We are not liable for any consequences arising from content you choose to post, whether AI-generated or manually written

The AI does not post content automatically. All review responses require your explicit approval before being published.

6. SMS and Telephony

The After Hours feature uses Twilio to provision phone numbers and send SMS messages on your behalf. By using this feature, you agree to:

• Comply with all applicable telecommunications laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
• Use SMS messaging only for legitimate business communications with customers who have contacted your business
• Not use the SMS features for mass marketing, spam, or unsolicited communications
• Comply with carrier messaging policies and guidelines

SMS messages are sent only in response to inbound calls to your Pylon-provisioned number. We do not initiate unsolicited outbound messaging on your behalf.

7. Intellectual Property

The Service, including its design, code, features, and branding, is the property of Advosec LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

You retain ownership of all content you provide to the Service, including business information, voice settings, and review responses you write or edit. You grant us a limited license to use this content solely to provide and improve the Service.

8. Third-Party Services

The Service integrates with third-party services including Google Business Profile, Twilio, Stripe, and others. Your use of these integrations is subject to the respective third party's terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
• We are not responsible for any loss of business, revenue, or customers resulting from missed calls, failed message delivery, delayed review responses, or any other Service interruption.
• In no event shall our total liability to you exceed the amount you paid us in the twelve (12) months preceding the claim.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or the theory of liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Advosec LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or any content you post or send through the Service.

11. Termination

Either party may terminate this agreement at any time:

• You may cancel your account through your account settings or by contacting support@thepylongroup.com.
• We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay applicable fees.
• We may terminate the Service entirely with 30 days' notice.

Upon termination, your right to use the Service ceases immediately (or at the end of your current billing period for voluntary cancellations). We may delete your data in accordance with our Privacy Policy.

12. Modifications to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. For significant changes, we will also notify you by email. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Advosec LLC regarding the Service and supersede all prior agreements, understandings, and communications.
